Welcome to Mi-Belle Apparel & Embroidery. By using the mi-belle.ca website, you agree to be bound by the conditions of use that are outlined below. This includes all terms and conditions, legal notices, and disclaimers listed across the mi-bell.ca website. You should carefully read the Terms and Conditions before Using the Site.

Mi-Belle Apparel & Embroidery reserves the right to make changes to the mi-belle.ca website and its Conditions of Use and Legal Notices at any time. Each time you use the mi-belle.ca website, you should visit and review the then current Conditions of Use and Legal Notices that apply to your transactions and use of this site. If you are dissatisfied with the mi-belle.ca website, its content or Conditions of Use and Legal Notices, you agree that your sole and exclusive remedy is to discontinue using the mi-belle.ca website.

Any malicious activity on the site, including but not limited to tampering with the site, misrepresenting the identity of a user, using buying agents or conducting fraudulent activities on the site is strictly prohibited.

Disclaimers and Limitation of Liability

By using the mi-belle.ca website, you explicitly agree that use of the website is at your sole risk. The website is provided on as "AS IS" and "as available" basis. Mi-Belle Apparel & Embroidery nor its affiliates, subsidiaries, or designees nor each of their respective officers, directors, employees, agents, third-party content providers, designers, contractors, distributors, merchants, sponsors, licensors, or the like (collectively, "Associates") warrant that use of the website will be uninterrupted or error-free. Neither Mi-Belle Apparel & Embroidery nor its Associates warrant the accuracy, integrity or completeness of the content provided on the website or the products or services offered for sale on the website.

Further, Mi-Belle Apparel & Embroidery makes no representation that content provided on the website is applicable to, or appropriate for use in, locations outside of Canada. Mi-Belle Apparel & Embroidery and its Associates specifically disclaim all warranties, whether expressed or implied, including but not limited to warranties of title, merchantability, or fitness for a particular purpose. No oral advice or written information given by Tshirtideal.ca or its Associates shall create a warranty. Some provinces do not allow the exclusion or limitation of certain warranties, so the above limitation or exclusion may not apply to you.

Under no circumstances shall Mi-Belle Apparel & Embroidery or its Associates be liable for any direct, indirect, incidental, special or consequential damages that result from your use of or inability to use the website, including but not limited to reliance by you on any information obtained from the website that results in mistakes, omissions, interruptions, deletion or corruption of files, viruses, delays in operation or transmission, or any failure of performance. The foregoing Limitation of Liability shall apply in any action, whether in contract, tort, or any other claim, even if an authorized representative of Tshirtideal.ca has been advised of or should have knowledge of the possibility of such damages. User hereby acknowledges that this paragraph shall apply to all content, merchandise, and services available through the Tshirtideal.ca website. Some provinces do not allow the exclusion or limitation of incidental or consequential damages, so the above limitation or exclusion may not apply to you. 

User Submissions.

User Submissions. Information you transmit to the Site is not confidential or proprietary. mibelle.ca may use any information you transmit through the Site on an unrestricted basis. This may include personal information about you and your use of the Site. 

Product Display/Colours

The mi-belle.ca website attempts to display product images shown on the site as accurately as possible. However, we cannot guarantee that the color you see matches the product color, as the display of the color depends, in part, upon the monitor you are using. Some variances can and should be expected.

Errors on Our Site

Prices and availability of products and services are subject to change without notice. Errors will be corrected where discovered, and Mi-Belle Apparel & Embroidery reserves the right to revoke any stated offer and to correct any errors, inaccuracies or omissions including after an order has been submitted, whether the order has been confirmed and your credit card charged. If your credit card has already been charged for the purchase and your order is cancelled, Mi-Belle Apparel & Embroidery will issue a refund to your credit card account in the amount of the charge. Individual bank policies will dictate when this amount is credited to your account. If you are not fully satisfied with your purchase, you may return it in accordance with Mi-Belle Apparel & Embroidery Return Policy

Sales Tax Policy

All prices do not include taxes (G.S.T., HST, or others). All orders are subject to acceptance by our Order Desk. All prices are subject to change without notice. Mi-Belle Apparel & Embroidery does business throughout Canada and collects and remits sales tax as required by law, the website also collects and remits sales tax as appropriate. Individuals that have provided either a PST number or Certificate of Resale (residing in the province of British Columbia), or those that meet the requirements for First Nations Indigenous Status are eligible for tax exemptions. For First Nations tax exemption, Mi-Belle Apparel & Embroidery a must be sent a photo of the front and back of the status card of the person placing the order, and the shipment must be delivered to reserve land.

Price different from one webpage to another?

There are many factors as to why prices may show up differently than the "price" advertised on our website. There may be different prices for different sizes on the website to reflect the different prices from our Suppliers.

Content Caching is another reason the price shown may be different from one page to another. We make every effort to ensure the information on this website is up to date however, some internet technology providers outside of our control may use technologies known as "content caching". Examples of "content caching is where your web browser (user agent) is set to: "store temporary internet files" or "make a page available offline". Additionally, Internet Service Providers (ISPs) and networks may use "caching servers" which serve up copies of web pages they have stored rather than requesting the actual and most up to date content from our servers. Search Engines/Directories and Archive Technologies such as "web.archive.org" may also offer up cached copies of old web pages which are many years out of date. Google and other search engines also offer cached copies of pages which, again, may not reflect the current data and pricing information on our websites. We cannot be held responsible and cannot honor cached pricing information from third party caching servers over which we have no control.

Payment

If you have chosen Visa, MasterCard, or PayPal, your credit card or PayPal account will be charged the full order total when you select ‘Place Order’ at the checkout. Any adjustments to the order after it has been placed will be issued either as a refund to the original payment, or as an additional transaction. Customers that have optioned to e-Transfer their payment (if available) will be contacted with full instructions on how to fulfill the transfer. Orders with e-Transfer selected will not be shipped until Mi-Belle Apparel & Embroidery has received the full payment amount. Mi-Belle Apparel & Embroidery will not hold inventory for any order placed until we have received payment in full. Mi-Belle Apparel & Embroidery does not accept Purchase Orders, with the only exception being for schools. Any school that wishes to pay for their order with a cheque must still submit the order online by selecting the ‘e-Transfer’ payment method. Schools paying with cheque must remit their payment within Net 30 days.

Validating:

After you place an order using our shopping cart, we will check the information you give us for validity, by verifying your method of payment and/or shipping address. We reserve the right to reject any order you place with us, and/or to limit quantities on any order, without giving any reason. If we reject your order, we will attempt to notify you using the email address you have given us with the order.

If an order is rejected, we will process a refund to the charge that has been made against your card.

Your receipt of an electronic or other form of order confirmation does not signify our acceptance of your order, nor does it constitute confirmation of our offer to sell. The mi-belle.ca website reserves the right at any time after receipt of your order to accept or decline your order for any reason.

Freight

All freight and shipping charges are F.O.B point of origin. Free freight is permitted according to Mi-Belle Apparel & Embroidery Terms and Conditions, and according to the carrier of our choice, unless otherwise specified. If additional transport costs were to apply, it is the customer’s responsibility to ensure payment, even in the case of free shipping. Here is a list of additional fees commonly charged to Mi-Belle Apparel & Embroidery by carriers: wrong delivery address provided by customer, use of tailgate, wait time at delivery, delivery in a private residence, inside delivery, 2nd delivery attempt, refused delivery and remote area delivery. Please note this list is non-exhaustive.

Reserved property:

The merchandise sold remains the property of Mi-Belle Apparel & Embroidery until full and final payment is received.

Termination.

Your failure to comply with any of the Terms automatically revokes your authorization to use the Site, Marketing Tools, and Software, and terminates any and all rights granted to you under the Terms.
